1. ACCEPTANCE OF TERMS
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Platinum LV ("Platinum LV," "we," "us," or "our"), governing your use of our premium real estate insights and services for the Las Vegas market. By accessing our website, engaging our services, or communicating with our representatives, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, you must immediately discontinue use of our services and refrain from engaging with Platinum LV. Your continued use of our services constitutes ongoing acceptance of these Terms and any modifications thereto.
2. SERVICE DESCRIPTION
Platinum LV provides premium real estate insights and services specifically tailored to the Las Vegas luxury real estate market. Our services include, but are not limited to:
Luxury Buyer Representation: We represent qualified buyers in the acquisition of luxury properties in the Las Vegas market, providing expert guidance, market intelligence, property identification, negotiation services, and transaction coordination.
Premium Listing Strategy: We offer comprehensive marketing and sales strategies for luxury property sellers, including market positioning, professional marketing materials, targeted exposure, pricing strategy, and negotiation expertise.
Market Insight & Advisory: We provide sophisticated market analysis, investment advisory, trend forecasting, portfolio consultation, and strategic real estate planning for the Las Vegas luxury market.
All services are provided on a professional basis subject to applicable real estate laws and regulations. Service availability may vary based on market conditions, property availability, and client qualifications. We reserve the right to decline service to any prospective client at our sole discretion.
3. USER OBLIGATIONS
By engaging with Platinum LV, you agree to:
Provide accurate, complete, and current information when requested, including but not limited to financial qualifications, contact information, property preferences, and identification documents.
Respond to communications from Platinum LV in a timely manner to facilitate efficient service delivery.
Maintain confidentiality of any proprietary market insights, property information, or strategic advice provided by Platinum LV.
Conduct yourself professionally and courteously in all interactions with Platinum LV representatives, partner organizations, and third parties involved in transactions.
Comply with all applicable laws and regulations related to real estate transactions, including fair housing laws and financial disclosure requirements.
Refrain from using our services for any unlawful purpose or in any manner that could damage, disable, or impair our business operations.
Notify us immediately of any changes to your contact information, financial status, or property requirements that may affect service delivery.
4. APPOINTMENT SCHEDULING AND CANCELLATIONS

Scheduling: All appointment requests are subject to availability and confirmation by Platinum LV. We will make reasonable efforts to accommodate your preferred dates and times.
Cancellations: Clients must provide at least 24 hours advance notice for cancellation or rescheduling of appointments. Failure to provide adequate notice may result in cancellation fees or restrictions on future service availability.
No-Show Policy: Failure to attend a scheduled appointment without prior notice constitutes a no-show and may result in fees, service restrictions, or termination of the client relationship at our discretion.
Property Showings: Third-party property showings are subject to seller availability and requirements. We cannot guarantee access to specific properties and are not responsible for scheduling conflicts or access denials beyond our control.
5. PAYMENT TERMS
Compensation Structure: Platinum LV's compensation for services is typically structured according to industry standards and Nevada real estate regulations. Specific fee arrangements will be outlined in separate representation agreements or service contracts.
Buyer Representation: Buyer representation services are generally compensated through cooperation with listing brokers. In cases where cooperative compensation is unavailable or insufficient, alternative fee arrangements will be clearly disclosed and agreed upon in writing prior to engagement.
Seller Representation: Seller representation services are compensated through commission structures detailed in exclusive listing agreements, payable at closing from sale proceeds.
Advisory Services: Market insight and advisory services may be provided on a fee-for-service basis, with rates and payment terms specified in separate consulting agreements.
Payment Terms: All fees are due according to the terms specified in individual service agreements. Late payments may incur interest charges at the maximum rate permitted by law.
Non-Refundable Fees: Certain fees, including but not limited to marketing costs, administrative fees, and advisory retainers, may be non-refundable as specified in service agreements.
6. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Platinum LV, its principals, agents, employees, and affiliated parties shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services, including but not limited to:
Lost profits or investment opportunities resulting from market fluctuations, timing, or property availability.
Damages resulting from inaccurate information provided by third parties, including sellers, listing agents, inspectors, appraisers, or public records.
Outcomes of real estate transactions, including purchase price, sale price, property condition, or investment performance.
Delays in transactions caused by lenders, escrow companies, title companies, or other third parties.
Market changes, economic conditions, or regulatory developments affecting property values or transaction feasibility.
Technology failures, communication disruptions, or data security incidents beyond our reasonable control.
Our total aggregate liability for any claims arising from our services shall not exceed the total fees paid by you to Platinum LV for the specific services giving rise to the claim.
Nothing in these Terms shall limit liability for fraud, gross negligence, willful misconduct, or matters that cannot be limited under applicable law.
7. WARRANTY DISCLAIMERS
Platinum LV provides services on an "as is" and "as available" basis. We make no warranties, express or implied, regarding our services, including but not limited to:
No Guarantee of Results: We do not guarantee that buyers will successfully acquire properties, that sellers will achieve specific sale prices or timeframes, or that any particular outcome will result from our services.
Market Information: While we strive to provide accurate and current market insights, we make no warranties regarding the accuracy, completeness, or timeliness of market data, property information, or analytical projections. Real estate markets are inherently unpredictable and subject to rapid change.
Third-Party Information: We disclaim all warranties regarding information provided by third parties, including property disclosures, inspections, appraisals, title reports, and public records. Clients are responsible for conducting their own due diligence.
Property Condition: We make no representations or warranties regarding the physical condition, legal status, or fitness for purpose of any property. Clients are strongly encouraged to obtain professional inspections and legal counsel.
Investment Performance: Past market performance does not guarantee future results. We provide no warranties regarding investment returns, appreciation, rental income, or other financial outcomes.
Service Availability: We do not warrant uninterrupted or error-free service delivery and reserve the right to modify or discontinue services at any time.
8. GOVERNING LAW
These Terms shall be governed by and construed in accordance with applicable federal laws and regulations governing real estate transactions. Any disputes arising from these Terms or our services shall be resolved through binding arbitration or in courts of competent jurisdiction as specified in individual service agreements.
The prevailing party in any legal proceeding related to these Terms shall be entitled to recover reasonable attorneys' fees and costs.
9. INTELLECTUAL PROPERTY
All content, materials, marketing presentations, market analyses, and proprietary insights provided by Platinum LV remain our exclusive intellectual property. Clients may not reproduce, distribute, or disclose such materials without our express written consent.
10. CONFIDENTIALITY
Platinum LV maintains strict confidentiality regarding client information in accordance with real estate industry standards and applicable privacy laws. However, certain information may be shared with transaction parties, service providers, and regulatory authorities as necessary to facilitate transactions and comply with legal obligations.
11. TERMINATION
Either party may terminate the service relationship subject to the terms specified in individual representation or service agreements. Termination does not relieve clients of obligations to pay for services already rendered or costs already incurred.
12. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Platinum LV and its principals, agents, and employees from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms, violation of applicable laws, or misrepresentation of information.
13. SEVERABILITY
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
14. ENTIRE AGREEMENT
These Terms, together with any separate service agreements, representation agreements, or consulting contracts, constitute the entire agreement between you and Platinum LV regarding our services and supersede all prior communications and agreements.
